San Onofre: NRC Wants More Analysis At Ailing California Nuke Plant

LOS ANGELES ? Federal regulators Wednesday pressed the operator of the San Onofre nuclear power plant for more analysis on its damaged steam generators, as the government considers when, or if, one of the seaside reactors can be restarted safely.

San Onofre, located between Los Angeles and San Diego, hasn't produced electricity since January, after a tiny radiation leak led to the discovery of excessive wear on hundreds of generator tubes that carry radioactive water.

Southern California Edison asked the Nuclear Regulatory Commission in early October for permission to rekindle one of the twin reactors, Unit 2, and then run it at reduced power. Company officials believe that operating at up to 70 percent power will end vibration and friction that prematurely eroded generator tubing.

In a letter to Edison, NRC officials raised a potentially thorny question for the company.

Under technical operating rules, the plant is required to ensure that generator tubes retain "structural integrity" during "the full range of normal operating conditions," including if the plant is running at full power. NRC said it wanted the company to demonstrate that Unit 2 could meet that threshold, or explain how generator tubes would interact with each other if the plant is operating at maximum capacity.

Any change in those technical rules could trigger a longer, more complex review by the NRC. Agency spokesman Victor Dricks declined comment when asked if meeting the full-power threshold could be a condition of restarting the Unit 2 reactor.

Edison spokeswoman Jennifer Manfre said in a statement that the utility would provide additional information to the federal agency, as requested. A thorough review of the restart plan "is important to both the public and Southern California Edison," she added.

The problems at San Onofre center on steam generators that were installed during a $670 million overhaul in 2009 and 2010. After the plant was shut down, tests found some generator tubes were so badly corroded that they could fail and possibly release radiation, a stunning finding inside the nearly new equipment.

Friends of the Earth, a group critical of the nuclear power industry, is among several environmental groups pushing the NRC to require Edison to seek an amendment to its operating license to restart the plant, a process that could take up to two years. Spokeswoman Kendra Ulrich said in a statement the group is "encouraged that the NRC is asking hard questions" about the restart and its implications, including on the operating license.

The ability of San Onofre to run safely at lower power ? and whether that limit would require an amendment to its operating license ? came up earlier this month at a hearing of the Atomic Safety and Licensing Board, an arm of the NRC.

Administrative Judge Gary Arnold asked an Edison attorney, Steve Frantz, if he was confident that the plant could operate at 99 percent power with its ailing generators.

"I do not say that," Franz responded. He argued that running at 70 percent power would fall within San Onofre's license and operating rules.

The generators, which resemble massive steel fire hydrants, control heat in the reactors and operate something like a car radiator. At San Onofre, each one stands 65 feet high, weighs 1.3 million pounds and has with 9,727 U-shaped tubes inside, each three-quarters of an inch in diameter.

Company executives have left open the possibility that the heavily damaged generators in Unit 3 might be scrapped.

Cracked and corroded generator tubing has vexed the nation's nuclear industry for years.

Decaying generator tubes helped push San Onofre's Unit 1 reactor into retirement in 1992, even though it was designed to run until 2004. The following year, the Trojan nuclear plant, near Portland, Oregon, was shuttered because of microscopic cracks in steam generator tubes, cutting years off its expected lifespan.

San Onofre is owned by SCE, San Diego Gas & Electric and the city of Riverside. The Unit 1 reactor operated from 1968 to 1992, when it was shut down and dismantled.

Former Braves player arrested on battery charge

DULUTH, Ga. (AP) ? Former Atlanta Braves star center fielder Andruw Jones was free on bond after being arrested in suburban Atlanta early Tuesday on a battery charge, according to jail records.

Around 1:30 a.m. Tuesday, police responded to a call for a domestic dispute between Jones and his wife in Duluth.

Gwinnett County Detention Center records say Jones was booked into the jail around 3:45 a.m. and was released on $2,400 bond by 11 a.m.

Once one of the premier players in the big leagues, Jones broke into the majors with the Atlanta Braves in 1996 and won 10 consecutive Gold Gloves from 1998-07 as their center fielder. He has 434 career home runs over the span of 17 seasons in the majors.

Jones earlier this month signed a $3.5 million, one-year contract with the Tohoku Rakuten Golden Eagles of Japan's Pacific League.

Divide your tasks into bandwidth-heavy and bandwidth-light. Evaluate your routine web tasks and see which ones you can do with a slow connection, and which ones require a faster, more reliable one. This is especially important if your mobile Internet provider charges based on bandwidth usage instead of time. This is particularly useful if you know you're going to be stuck on a slow connection, but even if you get yourself in a bind, you can still do some re-prioritization quickly. If you have some Internet-heavy tasks that can't wait, you should delegate them to someone else if you can???heck, even offer to pick up some of your co-workers' Internet-light load if they can help you out.

Tweak your browser for low-speed connections
Chances are, your browser isn't exactly primed for slow Internet speeds. So, we recommend grabbing a second browser that you can tweak to work better with slow connections. Opera is a great choice, because it has a Turbo Mode that optimizes the Web for faster loading, but no matter what, there are a number of tweaks you can make to speed up your browser, like:

Heck, you can even compose an email in Notepad while you wait for it to load???don't waste any time watching a progress bar when you could be doing something else.

When you do have to work in your browser, try not to put too much stress on it. Open one tab at a time, so you aren't trying to load a bunch of pages at once (since it'll take them longer, and you can only read one at a time). Close tabs you aren't using often, as they can often take up bandwidth even if you aren't looking at them.

Turn off bandwidth-sucking background apps?
With all the focus on your browser, you may forget that other apps like Dropbox might be taking up precious bandwidth in the background. Close any and all of those you don't need to do your work, or put them into offline mode so they aren't constantly checking if they need to sync. Some apps may require some foresight for this to work: Notational Velocity and ResophNotes will work fine without a connection, for example, but Evernote will require you to go into its settings and download your notebooks before it'll work in offline mode.

When all else fails, find better Wi-Fi?
No one wants to rush around all day trying to find better Internet, but if what you're using is just too slow, look elsewhere. Free Wi-Fi is everywhere, and if at first you don't succeed, find a faster hotspot. You won't be able to do this all day if you have work to get done, but you should be able to find something that's somewhat workable for the time being.

At Christmas Eve Mass, pope urges space for God

VATICAN CITY (AP) ? Pope Benedict XVI marked Christmas Eve with Mass in St. Peter's Basilica and a pressing question: Will people find room in their hectic, technology-driven lives for children, the poor and God?

The pontiff also prayed that Israelis and Palestinians live in peace and freedom, and asked the faithful to pray for strife-torn Syria as well as Lebanon and Iraq.

The ceremony began at 10 p.m. local time Monday with the blare of trumpets, meant to symbolize Christian joy over the news of Christ's birth in Bethlehem. As midnight neared, chuch bells tolled throughout Rome, while inside the basilica, the sweet voices of the Vatican's boys' choir resounded joyously.

Christmas Eve Mass at the Vatican traditionally began at midnight, but the start time was moved up years ago so as to give the 85-year-old pontiff more time to rest before his Christmas Day speech. That address is to be delivered at midday Tuesday from the basilica's central balcony.

A smiling Benedict, dressed in gold-colored vestments, waved to photo-snapping pilgrims and applauding church-goers as he glided up the center aisle toward the ornate main altar of the cavernous basilica on a wheeled platform guided by white-gloved aides. The platform saves him energy.

In his homily, Benedict cited the Gospel account of Mary and Joseph finding no room at an inn and ending up in a stable which sheltered the baby Jesus. He urged people to reflect upon what they find time for in their busy, technology-driven lives.

"The great moral question of our attitude toward the homeless, toward refugees and migrants takes on a deeper dimension: Do we really have room for God when he seeks to enter under our roof? Do we have time and space for him?" the pope said.

"The faster we can move, the more efficient our time-saving appliances become, the less time we have. And God? The question of God never seems urgent," Benedict lamented.

The pope worried that "we are so 'full' of ourselves that there is no room left for God." He added, "that means there is no room for others either ? for children, for the poor, for the stranger."

With his voice a bit hoarse, and looking somewhat tired as the two-hour ceremony neared its end, Benedict decried that history has suffered through "misuse of religion," when belief in one God became a pretext for intolerance and violence. Still, he insisted that where God is "forgotten or even denied, there is no peace either."

"Let us pray that Israelis and Palestinians be able to live their lives in the peace of the one God and in freedom," the pope said.

Benedict also mentioned his hope for progress in Syria, which is mired in civil war, as well as Lebanon and Iraq.

Reflecting the Vatican's concern about the exodus of many fearful Christians from the Muslim-dominated Middle East, Benedict expressed hope that "Christians in those lands where our faith was born maybe be able to continue living there" and that Christians and Muslims "build up their countries side by side in God's peace."

Hours before the basilica Mass, Benedict lit a Christmas peace candle on the windowsill of his studio window overlooking St. Peter's Square.

Promised Land Movie Review: For Matt Damon and Company, the ...

Salesmen are typically depicted in screen drama as the quintessential American phonies. The exceptions ? in Barry Levinson's Avalon or Whit Stillman's Barcelona ? are buried under a mountain of films proving the rule. That one set of phonies are being dramatically indicted by actors is an irony that we will leave hanging.

When we first meet Promised Land's phony, played by Matt Damon, he's preparing to sell himself, to audition. Steve Butler is interviewing for an executive position at Global, a natural gas company whose bread and butter is fracking, the controversial practice of pumping toxic chemicals 8,000 feet underground to loosen up natural gas. Steve travels from small town to small town and persuades people to sell Global leases to extract on their land, and his ace results have attracted attention. He explains that this is a matter of his common touch with locals: "I'm from Eldridge, Iowa. It might as well be Rifle, Colorado; Dish, Texas; or Lafayette, Louisiana. I know them, they know me."

Steve says his work is inspired by a sense of duty to these dying mill towns ? "I'm selling them the only way they have to get back" ? though an edge in his voice belies a deeper frustration and disappointment. Whether that frustration is with these people he claims to know or actually with himself is tested on a by-the-book sales trip to a town called McKinley in Western Pennsylvania. His partner, Sue, meets him there with a suitably beat-up Ford, their prop transportation; Sue is played by Frances McDormand, keeping up her end of a testy on-the-job rapport that's a low-key pleasure. When they go shopping for middle-American costumes, Steve chooses plaid over camouflage, though, really, it's all camouflage.

Steve's approach assumes that all of flyover America is essentially the same. "I can't believe this is right outside the city; it looks like Kentucky," says Sue, to which Steve responds, "Two hours outside any city looks like Kentucky." And everything is routine at first ? the bribe to the local politician (a nicely played scene performed with hushed, hardball contempt by Damon) and the well-oiled pitches to property owners. But a science teacher (Hal Holbrook) speaks up at a community assembly, citing reports that fracking can contaminate water supplies, which leads the assembly to set a date three weeks off to vote on allowing Global to drill. This forces Steve and Sue to stick around McKinley and gives time for an environmental-agency worker (John Krasinski) to go door to door with a story about how fracking killed his family dairy farm.

Krasinski, shading his trademark affability with a touch of cocky righteousness, has the unlikely handle Dustin Noble, the actor's second most unfortunate character name outside of Burt Farlander in 2009's Away We Go, written by Dave Eggers. Eggers is credited with Promised Land's original story, which Damon and Krasinski developed into a screenplay; Damon was originally slated to make the project his directorial debut, but it instead wound up with Good Will Hunting director Gus Van Sant, who here is again in his deft, accessible, director-for-hire mode. Like Steve, Van Sant ? who has a history in advertising ? knows how to dress down and display the common touch.

With Swedish cinematographer Linus Sandgren, Van Sant has shot McKinley as an NPR-tithing audience's dream of the idyllic small town seen in folksy music-video interludes, without an eyesore Walmart in sight. In fact, it offers little sense of the hard-times desperation that Steve's pitch assumes ? strange considering this film is the work of the director of Drugstore Cowboy, who has made a career of going down among the marginalized.

The PR war is waged through Steve and Dustin's competition over a local schoolteacher (Rosemarie DeWitt) and in McKinley's social centers: the diner, where Dustin gets tauntingly back-slappy with the locals, and the bar, where Sue takes the stage to sing Hank Williams's gospel standard "I Saw the Light" to win hearts and minds. Hank Jr.'s "Family Tradition" is the true surefire crowd-pleaser, but her selection is significant; should it be doubted that environmentalism has adopted the trappings and language of religion, note that Promised Land (title courtesy Genesis 15:18-21) is essentially a conversion story, in which the cynical Steve is swayed from Global doctrine to the "delusional self-mythology" of prideful small-town independence he's first heard scoffing at.

But though Steve knows the Global line backward and forward ("If you are against this, you're for coal and oil. Period."), his conviction seems to be wavering even as he delivers it. Steve's conversion lacks dramatic heft, then, for it seems more a matter of predestination, his profound discomfort something incipient to his existence rather than the result of a slow undermining of confidence. New flecks of gray show at Damon's temples, and foreboding of a looming existential cliff shows at once in Steve's clumping gait, the sullen way he drinks, the ease with which Dustin gets under his skin. (Did Damon think of guiltily counting his Bourne bucks?)

Promised Land is a hard-sell movie because it doesn't have the confidence in its audience to make any other outcome seem personally viable, to give the opposition a fighting chance or persuasive voice. Fast Food Nation gave Bruce Willis's corporate higher-up the floor to deliver a tough, pragmatic monologue ending in "We all gotta eat a little shit from time to time" ? a rogue element that gave an ideologically committed movie greater strength through tension. Ultimately, what causes the scales to fall from Steve's eyes is his discovery that Global has been playing with a stacked deck, making sure they can't lose. Here, Promised Land, whose ending never once seems in doubt, exemplifies in dramatic structure the same cheating its hero can't stomach.

A chipped street mural in South Africa's Soweto township depicts stations in the life of Nelson Mandela, each matched by a portrait of the global icon as he advanced from robust youth to old age. Now this infirm giant of history faces a struggle with mortality, its duration unknown but its outcome certain.

There may be no living figure so revered around the world as a symbol of sacrifice and reconciliation, his legacy forged in the fight against apartheid, the system of white minority rule that imprisoned him for 27 years.

As an idea, Mandela is monumental. As a 94-year-old man, he is frail and vulnerable, in hospital since Dec. 8, shielded from outside scrutiny by protective relatives and the South African government and military.

"He's sick. What can we do? He's sick," said Beauty Sedunedi, a Soweto resident who described Mandela as a hero. "People are crying, 'Oh, he mustn't die, he mustn't...' If God says 'come,' he'll come."

The former president would probably agree with that down-to-earth sentiment, as a man who is said to have been uncomfortable with his iconic status. The narrative of what he endured and what he contributed in the name of all South Africans tends to eclipse any personal failings, or shortcomings as a president when he took office for a five-year term after the country's first democratic elections in 1994. The country today struggles with poverty and inequality, but Mandela is widely credited with helping to avert race-driven chaos as South Africa emerged from apartheid.

He was diagnosed with a lung infection and had a procedure to remove gallstones after being admitted to a Pretoria hospital, and the South African presidency said Monday that Mandela would spend Christmas Day there. The physical decline of Mandela, who boxed in his youth and exercised regularly in prison, could be anyone's story; an ordinary man would make this wistful journey alone, or within the cocoon of family intimacy.

In the case of a man-turned-myth, however, the media, the government and the nation are passengers on what has become an awkward ride, defined by tension between the right to medical privacy and the public's interest.

"They were very secretive about his health," Sebastian Moloi, another resident of the Johannesburg township of Soweto, said of the government's initial, sometimes contradictory pronouncements about Mandela's condition. "They shouldn't keep it away from the public."

Moloi spoke outside Regina Mundi, a Catholic church that was a center of protests and funeral services for activists during the apartheid years. He said Mandela was the "godfather" of South Africa, but objected to extreme discretion about Mandela's hospital stay, saying: "He gets enough privacy in his home."

Officials have reported that Mandela has steadily improved, but warn the situation is inherently uncertain because of his age. The media has urged the government to provide regular updates or briefings with doctors. Dire rumors have swirled on social media, angering Mac Maharaj, the presidency's spokesman.

"Why are there no voices raised in our society against the human depravity manifested in such rumors?" Eyewitness News, a South African media outlet, quoted Maharaj as saying. "It has become a matter of concern. Is it not time for all of us to look at ourselves in the mirror?"

In fact, Mandela's public image has been closely managed for a long time. He has not been seen on a major stage since South Africa hosted the World Cup football tournament in 2010, and his meetings have become increasingly rare.

In August, U.S. Secretary of State Hillary Clinton visited Mandela at his home in the village of Qunu in Eastern Cape province. An Associated Press photographer who accompanied Clinton said the former leader appeared "fragile although also happy," and seemed pleased to see his visitor.

"After some deliberation, at the last moment, I was allowed inside to photograph them together. While I was in the room I never heard him say a word or hardly even move," photographer Jacquelyn Martin wrote in an email. She described how aides encouraged Mandela to smile for the camera and remarked fondly to him on what a beautiful smile he had. They called him "Madiba," which is Mandela's clan name, a term of affection.

"He scarcely moved and was a whisper of the legend," Martin wrote. She said Mandela was seated in a corner with a blanket over his legs and a newspaper in his lap. His wife, Graca Machel, was also there.

In 2009, British journalist David James Smith met the Nobel laureate while working on "Young Mandela," a book that sought, in part, to humanize the man by examining reports about his often conflicted family life.

In an email, Smith said he was required to sign a document promising he would not ask "direct questions," take photos or ask Mandela to endorse any products.

"He was sitting in his huge office behind a massive desk and seemed slightly shrivelled and sparrow-like in comparison with the sharp-suited giant of the 1950s I had come to know so well from my research," Smith wrote.

"He apologized for not getting up to greet me. 'My knees will not allow it.' I struggled to get a conversation going for a few minutes until I told him I had been to Qunu and met his 'brother' Sitsheketshe, who had been brought up with Mandela as his brother after his own parents had died."

Smith recounted: "'Ah, Sitsheketshe!' he boomed. 'Do you know the story of how he came to live with my family?' I did but said I didn't and off he went ... He seemed mortal and ordinary and that I think is one of the reasons why, though not a saint, he is a very great human being."

Sitsheketshe Morris Mandela, Nelson's cousin, died this year at the age of 80.

History offers rough parallels for Mandela and the movement to safeguard his legacy as he approaches the end of his life. Men of his stature ? American civil rights activist Martin Luther King Jr. and Indian independence leader Mohandas K. Gandhi ? were assassinated while actively engaged in their callings. Tragedy elevated their reputations.

The Soweto mural marks Mandela's birth in 1918; the Rivonia trial that led to his conviction for sabotage in 1964; the 1990 release from prison; the 1993 awarding of the Nobel peace prize to Mandela and the last white ruler, F.W. de Klerk; Mandela's 1994 election as South Africa's first black president; and his 90th birthday in 2008.

Truly, a momentous life. Yet Mandela, whose image adorns South African banknotes and statues and whose name was bestowed on buildings and squares, found ambiguity in it. In a passage described as part of an unpublished sequel to his autobiography, "Long Walk to Freedom," he wrote:

"One issue that deeply worried me in prison was the false image that I unwittingly projected to the outside world; of being regarded as a saint. I never was one, even on the basis of an earthly definition of a saint as a sinner who keeps on trying."

Reflecting on his 2009 meeting, Smith said in an interview that Mandela still retained his spark of charisma, "the glint of mischief that he had that people were so charmed by, presidents and paupers."

But he added: "You can imagine that must be almost gone now."

(AP) ? Authorities in central Pennsylvania are trying to determine why a man fatally shot three people along a rural road before being killed in a gunfight with police.

Police were still trying to piece together a timeline in the arduous investigation of the Friday shootings that began in Frankstown Township and spanned five crime scenes within a 1.5-mile radius.

A woman decorating a church hall for a children's Christmas party was among those killed. Three state troopers were injured.

Authorities haven't released a motive for the shootings.

"It's going to take us some time to put this all together ... and know exactly what occurred," said Lt. Col. George Bivens, a deputy state police commissioner.

Police did not release the names of the victims or the shooter, though they did say the man lived in Blair County, where all the shootings occurred. Clergy planned a prayer vigil Saturday for the victims, which included the woman at the Juniata Valley Gospel Church.

The gunman and the victims weren't related, though the victims may have been, at least distantly, Blair County District Attorney Rich Consiglio said.

Troopers were responding to a 911 call of a shooting in the township at about 9 a.m. Friday when they heard calls reporting at least one other shooting elsewhere, state police said.

The three troopers, in patrol cars, were injured in a pursuit that began after the gunman, driving a pickup truck, fired at them, police said. One trooper injured a wrist and then was hit in the chest but was saved by body armor.

A second trooper was injured by glass fragments in his eye and bullet fragments that hit him in the forehead, Bivens said.

The gunman was killed during a final exchange of gunfire after ramming his truck head-on into another police cruiser, authorities said. It was after that crash that the trooper shot in the wrist also was hit in the chest.

The third trooper suffered minor injuries from the head-on crash, Bivens said. More than one weapon was seized from the truck, Bivens added, but he declined to offer more specifics.

"I think we have three very fortunate state police members tonight," Bivens said Friday. "We are very thankful for the fact that they survived this attack. Someone was watching over them."

Besides the woman, one man was shot at a home and the other man was shot at a crash site where the gunman had used his truck to strike another vehicle, Bivens said.

But relatives of the victims said they were told the woman at the church was the first person shot, the Pittsburgh Tribune-Review reported. The gunman then shot two men in the driveway of a home after a confrontation at a stop sign, one of the men's cousins, Marie Brenneman, told the newspaper.

"This person went to their driveway with a pistol, pointed at them and started shooting," Brenneman said.

She said both men were the shooter's neighbors in the tiny village of Geeseytown, about 70 miles west of Harrisburg, the state capital.

"They were uneasy around him," she said.

The woman at the church had cooked food the day before for the funeral of the church's longtime pastor, said the Rev. James McCaulley, his brother. The church still was reeling from the death of the Rev. David McCaulley when the woman returned to decorate its hall, and bullets ripped through a window, he said.

The gunman then entered and shot one of two women before he left, the Rev. James McCaulley said.

Police identified the five crime scenes as the church; a home and ground around the home; a crash site where another victim was killed; the point in the road where the gunman opened fire on the troopers; and where the final encounter occurred after the truck collided with the police cruiser.

Bivens said investigators don't know if the victims were picked at random.

McCaulley, who is the pastor of another church about 50 miles from the site of Friday's carnage, said his older brother began leading the Frankstown church in 1954.

"He preached his last sermon at the church in October before he fell ill," McCaulley said.

The church, which lists about 150 members in an online ad posted this month seeking an associate pastor, is close-knit, and the woman killed Friday was among its more active members, McCaulley said. She had made food for him to take home Thursday since his wife had died this year, he said.

"The only thing I can say good at this time is that (the gunman) didn't do this 24 hours earlier when there was a big crowd in the church hall," McCaulley said. "We're devastated."

UK told to add break-up threat to bank reform

LONDON (Reuters) - Britain needs to introduce legislation that could break up banks if standards slip because current reform proposals fall short of what is needed, an influential parliamentary panel said.

The Parliamentary Commission on Banking Standards also said on Friday the government could set tougher rules for how much leverage banks were allowed, adding that the committee itself would consider whether to propose banning proprietary trading.

Britain, going further than most countries in pushing through change, is forcing banks to separate, or "ring-fence", their domestic retail arms from riskier investment banking.

"The proposals, as they stand, fall well short of what is required. Over time, the ring-fence will be tested and challenged by the banks," PCBS chairman Andrew Tyrie said.

"That is why we recommend electrification. The legislation needs to set out a reserve power for separation; the regulator needs to know he can use it."

The Treasury said Chancellor George Osborne will consider the proposals and respond when reforms are brought to Parliament early next year.

Osborne appears unlikely to go as far as the PCBS wants. A previous Commission, led by John Vickers, said a full break-up of banks was not needed, and Osborne may decide that if the ring-fence plan proved to be flawed, the Treasury could then introduce fresh legislation to strengthen it.

Britain wants to prevent a repeat of the need for taxpayers to bail out lenders, as happened in 2008 with a 65 billion pound ($106 billion) double rescue of Lloyds Banking Group and Royal Bank of Scotland.

The PCBS, asked to assess government plans before their introduction, said legislation should be introduced now because banks had to be discouraged from gaming the new rules for the ring-fence to succeed.

"All history tells us they will do this unless incentivised not to," Tyrie said, adding politicians could be lobbied to put holes in the ring-fence too.

"Additional powers are essential to provide adequate incentives for the banks to comply not just with the rules of the ring-fence, but also with their spirit," the Commission said in its 146-page report.

Bank shares fell up to 2.5 percent, underperforming a 1.1 percent lower European bank index.

"I would be concerned ... that a future, politically-motivated government or regulator could take draconian action with impunity. It would be putting in place a simple mechanism for banks to be picked on and to be broken up," Investec Securities analyst Ian Gordon said.

"One could argue that threat is there anyway and could be implemented," he said, adding the PCBS had added to uncertainty about reforms.

The threat of break-up would be most damaging to Barclays - whose shares fell 2.5 percent - and to a lesser degree to HSBC and RBS, analysts said.

In a concession to most banks, the PCBS said banks should be allowed to sell simple derivatives within their ring-fenced operation, which had been a point of contention.

The PCBS was set up after Barclays was fined for rigging global interest rates and banks were slammed for a series of mis-selling scandals.

Tyrie said the market rigging and corruption shown this week at Swiss bank UBS "beggar belief. It is the clearest illustration yet that a great deal more needs to be done to restore standards in banking.

Among plans to rein in risk-taking is a cap on leverage, which Britain plans to set at 33 times banks' capital - weaker than an original proposal for a maximum of 25 times.

The PCBS said it was "not persuaded by the government's relaxation" of that leverage rule, adding the future regulator, the Financial Policy Committee, should set the leverage cap.

Tyrie said it may also be appropriate for Britain to block banks from any proprietary trading - known as the Volcker Rule in the United States - and the PCBS will take evidence on that early next year.

The cross-party commission, which includes Justin Welby, the next Archbishop of Canterbury - the Church of England's most senior bishop - has spent the past three months deliberating the reform plans, taking evidence from the bosses of major banks as well as regulators, politicians and central bankers.

It said it was concerned too many reforms will be left to the discretion of the future regulator, and said the power to force bondholders to take losses when a bank hits trouble should be included in primary legislation.

Bernard Madoff's brother gets 10-year sentence

NEW YORK (AP) ? The brother of imprisoned financier Bernard Madoff was sentenced Thursday to 10 years in prison for crimes committed in the shadow of his notorious sibling by a judge who said she disbelieved his claims that he did not know about the epic fraud.

Peter Madoff, 67, had agreed when he pleaded guilty in June to serve the maximum sentence allowable to the charges of conspiracy and falsifying the books and records of an investment adviser. He follows to prison his 74-year-old brother, who is serving a 150-year sentence after admitting he created a fraud so large decades ago that thousands of people lost $20 billion.

U.S. District Judge Laura Taylor Swain urged Peter Madoff to tell the truth even now about what he knows about the fraud that cost thousands of investors their original $20 billion investment.

The judge said Peter Madoff, wearing a well-tailored charcoal suit, was "frankly not believable" when he claimed at his plea that he only learned of the fraud when his brother revealed it to him just before he surrendered to authorities.

Peter Madoff spoke only briefly, saying: "I am deeply ashamed of my conduct and have tried to atone by pleading guilty and have agreed to forfeit all of my present and future assets."

He added: "I am profoundly sorry that my failures let many people down, including my loved ones."

Two investors, among 40 who wrote victim impact statements, spoke during the proceeding, each describing the financial ruins of their extended family.

Investor Michael T. De Vita, 62, also called for truth, saying he believed "it to be physically impossible for a single person to carry out such a gargantuan task all by himself."

De Vita said investors "have waited four years for others to accept responsibility for this massive crime. We are still waiting for that today."

"All of this was preventable if only one person was willing to do the right thing and stop this in its tracks years ago. Peter Madoff could have been that person," he said.

Amy Luria Nissenbaum, 49, choking up at times, also complained that Peter Madoff had chosen even after his plea to "turn a blind eye" to his brother's fraud, saying her home was in foreclosure and some days she struggles to "clothe and feed my children."

Nissenbaum said Peter Madoff was part of his brother's fraud for more than 30 years and he should serve the same amount of time in prison.

When Swain announced that Peter Madoff will not have to report to prison until Feb. 6, Nissenbaum laughed out loud bitterly. The delay in reporting to prison will let Peter Madoff attend his granddaughter's Bat Mitzvah on Jan. 19.

The judge noted that 10 years was the maximum sentence allowed by the charges to which Madoff had pled and repeatedly urged Madoff to relieve the pain of investors by revealing more about the Madoff business.

"I challenge you to be honest about all that you have done and all that you have seen. In other words, all that you know," she said.

The magnitude of the damage done by the Madoffs cannot be underestimated, she said.

"Trust in financial institutions, thousands of individual lives and numerous charitable organizations have been blown apart," she said.

Assistant U.S. Attorney Lisa Baroni said it would have been easy for Peter Madoff to blow the whistle on the fraud. Instead, she said, he even conspired with his brother on how to distribute the remaining $300 million in the company's accounts to family, friends and favored clients before the FBI put an end to the fraud by arresting his brother.

The sentencing comes four years and a week after Bernard Madoff first revealed the fraud, which occurred as the former NASDAQ chairman built a reputation for delivering unparalleled investment results, even in bad times. The revelation came only days after the business sent out statements that made investors think their investments had grown to a total of more than $65 billion.

Peter Madoff said at his plea that he had no idea his brother was running a massive Ponzi scheme, paying off longtime investors at times with money from newer investors.

"My family was torn apart as a result of my brother's atrocious conduct," he said. "I was reviled by strangers as well as friends who assumed that I knew about the Ponzi scheme."

But he conceded that he followed his brother's instructions and helped him decide which favored friends, clients and family members would receive the $300 million that remained in the company's accounts. The checks were never sent.

Peter Madoff, who joined his brother's firm after graduating from Fordham Law School in 1970, has been free on $5 million bail after he agreed to surrender all of his assets.

Prior to sentencing, his lawyer, John Wing, said in a memorandum that Peter Madoff will "almost certainly live out his remaining days as a jobless pariah, in or out of prison." He called him a victim of his loyalty to his brother, saying he had been mistreated by the sibling who was eight years older and was viewed as "the prince" by his mother.

As part of a forfeiture agreement, Madoff's wife, Marion, and daughter Shana must forfeit nearly all of their assets. The government said those assets and assets that will be forfeited by other family members include several homes, a Ferrari and more than $10 million in cash and securities. It said his wife will be left with $771,733. Besides the Madoff brothers, no other family members have been arrested.

Though Madoff had been the firm's chief compliance officer for nearly four decades, the government marked his start in the conspiracy as 1996, when he created false and misleading compliance documents and false reports for the Securities and Exchange Commission.

The crime worsened after August 2006, when the business was registered with the SEC as an investment adviser, requiring annual filings to guide the SEC's examination programs. Prosecutors say Madoff made "numerous false statements" to create the false appearance that the business represented a small number of highly sophisticated clients.

Since the fraud was revealed, a court-appointed trustee has reached agreements to recover approximately $9.3 billion and is hoping to recover another $3 billion over the next 18 months. About $3 billion has been approved for redistribution to victims through an ongoing claims process.

Besides his brother, Peter Madoff is among six who have pleaded guilty in the case, including the former finance chief, a payroll manager, an accountant, a comptroller and a securities trader.

Five others face trial next year, including Bernard Madoff's longtime secretary. All have pleaded not guilty.
